Terms of Service
These Terms of Service ("Terms") outline the terms and conditions for your access and use of our website, rankengine.com ("Rank Engine"), and any related services ("Services").
Please read these Terms carefully before using our website or purchasing our Services. By using Rank Engine, you agree to be bound by these Terms. If you do not agree with any of these provisions, please do not use Rank Engine.
1. Definitions
For the purposes of these Terms:
- "Terms" means these Terms of Service.
- "Rank Engine" means our website (rankengine.com), platform, and any related online dashboard.
- "Services" means the content, outreach, and placement services offered via Rank Engine.
- "Account" means your registered user account on Rank Engine.
- "Order" means a purchase of Services submitted via Rank Engine, including through the Project Builder.
- "Project Builder" means the order configuration tool within Rank Engine which you use to specify campaign details, targets and preferences.
- "Active Order" means an Order that we are processing in the normal course, where we have the information and approvals we reasonably require and the Order has not been marked as a Dormant Order.
- "Dormant Order" means an Order that has been placed on hold by us due to prolonged inactivity on your side, as described in Section 5 under “Order Status and Dormant Orders”.
- "Publisher Submission" means the point at which we submit content or placement requests to third-party publishers or website owners for publication.
- "Company", "we", "our" mean Rank Engine Ltd., the provider of Rank Engine.
- "User", "you", "your" mean the person or entity using Rank Engine and its Services.
2. Agreement to Terms
By accessing or using Rank Engine, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you use Rank Engine on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms. If you do not have such authority, do not use Rank Engine.
3. User Account
To use our Services, you must register an Account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your Account.
We may suspend or terminate your Account if you violate these Terms or upon lawful request from authorities.
4. Your Commitments
By using Rank Engine, you agree to:
- Provide accurate and complete information when placing Orders;
- Not request services for websites that violate our content policies (see Section 6);
- Comply with all applicable laws.
You agree to indemnify and hold the Company harmless from any claims arising from your use of our Services.
5. Provision of Services
The Company provides Services to publish editorial content and link placements through outreach and content marketing. Users can order content and link placements via the Project Builder. Orders are fulfilled according to the delivery option you select (for example, 1-week delivery, 2-week delivery, or a 30-day drip feed), and progress is tracked via the dashboard and order management page. All such delivery timeframes are estimates only and are not guaranteed deadlines, although we will act reasonably to meet them.
Some Services may include approval stages, such as Content Approval and Placement Approval. Where an Order includes an approval or information stage, you agree to review and respond within a reasonable time. Our delivery timeframes apply only while an Order is active. Time during which we are waiting on your approval or information, or during which an Order is marked as a Dormant Order, is not counted towards our target delivery timeframes.
After completing Services, we will provide a report (in CSV format) with details of each obtained link and relevant domain metrics relating to each placement. For clarity, we do not provide keyword rank tracking or SERP position reporting, and we do not guarantee specific ranking positions. Services are delivered remotely, and you are responsible for providing all required information promptly.
We reserve the right to decline or cancel any content or placement request that violates these Terms or applicable laws.
Order Status and Dormant Orders
If we request your approval, feedback, or further information to progress an Order and you do not provide a meaningful response for 60 consecutive days, we may mark the Order as a Dormant Order and place it on hold. While an Order is a Dormant Order:
- We are not obliged to carry out further work or meet any delivery timeframe; and
- Any completion or delivery periods described in these Terms are paused and do not run.
You may request reactivation of a Dormant Order at any time before it is cancelled. Reactivation is subject to our operational capacity and, if your requirements have changed materially, may require Paid Reprocessing under Section 9.
If there is no meaningful activity or response from you in relation to an Order for 180 consecutive days from your last interaction with that Order, we may cancel the Order as a long-term Dormant Order. Cancellation of a Dormant Order under this section does not of itself entitle you to any refund; your refund rights (if any) are governed solely by Section 8.
6. Service Delivery Rules
- We cannot guarantee control over third-party platforms; edits or removals will be attempted but not guaranteed.
- You may provide keywords (for example, "Anchor Text"), but we are not responsible for keyword performance.
- Backlinks are placed on third-party platforms. We guarantee uptime for 730 days and will replace a placement that is removed within that period,
provided the removal is not caused by:- a breach of these Terms by you, including but not limited to the submission of infringing, unlawful, misleading or defamatory content; or
- your subsequent actions, requests or complaints to the publisher which directly cause the removal.
We may replace a removed placement on a different website of comparable type and quality where a like-for-like replacement on the original website is not reasonably possible.
- We do not accept Orders for adult, gambling, pharmaceuticals, racist, or illegal websites.
- Any delivery timelines or performance commitments described in these Terms, on Rank Engine, or in our marketing materials (including 1-week, 2-week or 30-day drip feed options) are estimates only and are not guaranteed deadlines. They apply only while an Order is active and do not include any period during which an Order is awaiting your approval or information, or is marked as a Dormant Order.
7. Fees and Payments
All payments are processed by our third-party payment processor, which may collect necessary personal and billing data. You are responsible for ensuring payment details are correct and funds available. The Company is not liable for failed transactions due to incorrect details or processor issues.
Account Credit
We may, at our discretion, add credit to your Account ("Account Credit"). Account Credit can be used solely for purchasing our Services through Rank Engine and is non-transferable, non-refundable, and has no cash value. Unless otherwise stated in writing, all Account Credit will expire 12 months from the date it is added to your Account. Expired credit cannot be reinstated or refunded.
8. Refund Policy and Money-Back Guarantee
Except as expressly set out in this Section 8 (including the first-time customer money-back guarantee), all fees are non-refundable. Refunds are not provided for change of mind, changes in your circumstances, or cancellations of Orders by you.
Standard Refund Grounds (our performance)
Refunds or other remedies may be provided where:
- Services are materially impaired due to technical issues that we cannot resolve within a reasonable period;
- We materially breach these Terms;
- We fail to acquire backlinks that materially match the agreed Order specifications, for example where placements:
- are published in the wrong language or target a clearly incorrect geography;
- fall materially outside the agreed domain authority or similar metric range; or
- are placed on websites that are clearly spam, link farms or otherwise materially below the quality level described in the Order.
- We fail to complete an Active Order within 60 days of Order acceptance and the delay is not caused by your acts or omissions.
Before issuing a refund in these situations, we may first attempt to remedy the issue, for example by replacing affected placements or re-performing the relevant part of the Services within a reasonable time.
If we cannot reasonably remedy the issue, and a refund is appropriate, we will provide a refund of the fees you paid for the affected part of the Services to your original payment method, unless we agree otherwise in writing. If an Active Order is not completed within 60 days for reasons that are not attributable to you, we will refund the fees paid for that Order in full, unless we have already delivered a substantial and usable part of the Services, in which case the refund may be made on a proportionate basis.
Time during which an Order is awaiting your approval or information, or is marked as a Dormant Order (see Section 5), is not counted towards the 60-day completion period above or any estimated delivery timeframe.
Customer Cancellations
If you cancel an Active Order or a Dormant Order for your own reasons, no refund will be provided, except where we are required to do so by applicable law or where we agree otherwise in writing at our sole discretion.
First-Time Customer Money-Back Guarantee
If you are a first-time customer, your first Order placed through Rank Engine is covered by the following money-back guarantee:
- We will provide complimentary Content Approval and Placement Approval on your first Order.
- If you are not satisfied during the approval stages of your first Order, you may cancel that Order and receive a 100% refund of the Order value to your original payment method.
- Once you have approved the content and placements for your first Order, or if your first Order becomes a Dormant Order under Section 5, this first-time money-back guarantee no longer applies to that Order.
This first-time money-back guarantee applies only to your first Order and does not apply to any subsequent Orders.
Refund Method
Unless otherwise stated in this Section 8, refunds are issued to the original payment method used for the relevant Order. We may, at our discretion, offer Account Credit instead of a cash refund where we consider that an alternative remedy is appropriate and you agree to this. Nothing in this Section 8 limits your statutory rights, if applicable.
9. Revisions Policy
Rank Engine provides unlimited reasonable revisions at no additional cost when they are based on the information originally submitted through the Project Builder, as well as factual corrections or adjustments necessary to comply with the originally agreed brief.
If successive revision cycles are not met with approval and we reasonably consider that we have fulfilled the original brief, Rank Engine may treat the work as complete and is not obliged to provide further revisions or a refund. If, after reasonable revision efforts, we determine that we have not met the original brief and cannot do so within a reasonable time, we may cancel the Order in whole or in part and treat this as a Standard Refund Ground under Section 8, in which case we may provide a refund for the affected part of the Services.
Paid Reprocessing
Requests that require content to be regenerated fall under Paid Reprocessing. This includes, but is not limited to:
- submission of new guidelines, messaging, or background information after the Order has started;
- changes in campaign scope or parameters beyond those originally specified in the Project Builder;
- requests that necessitate discarding existing drafts and producing new content due to new information provided by you;
- substantial changes requested on reactivation of a long-term Dormant Order.
These are considered Paid Reprocessing.
Reprocessing Fees
- Flat fee: €50 per Order
- €10 per article requiring regeneration
10. Disclaimer of Warranties
Rank Engine is provided "as is" and "as available". The Company disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We cannot guarantee all information is complete, up-to-date, or error-free, including content produced using AI or automated tools.
11. Limitation of Liability
The Company is not liable for any indirect, incidental, special, punitive or consequential damages, loss of profits, revenue, business, data or goodwill, in each case whether arising in contract, tort (including negligence) or otherwise, even if we have been advised of the possibility of such damages.
Subject to the paragraph below, our total aggregate liability arising out of or in connection with these Terms or the Services, whether in contract, tort (including negligence) or otherwise, shall in no event exceed the total fees paid by you to us for the Services in the 12 months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law.
This Section 11 applies to the fullest extent permitted by law. Some jurisdictions may not allow certain exclusions or limitations of liability, so the above may not fully apply to you.
12. Breach of Terms
If you violate these Terms, we may:
- Send a warning;
- Suspend or delete your Account;
- Prohibit Service access;
- Report to authorities;
- Take legal action.
13. Modifications to Services and Terms
We may modify, suspend or discontinue Rank Engine or any part of the Services at any time without liability to you, provided that such changes do not materially reduce the core functionality of Services you have already paid for without offering you a suitable remedy.
We may also update these Terms from time to time. When we do so, we will post the updated Terms on Rank Engine and update the “last updated” date. In some cases, we may also notify you by email or via your Account. Your continued use of Rank Engine or the Services after the updated Terms take effect will constitute your acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using Rank Engine and the Services.
We do not guarantee uninterrupted or secure access to Rank Engine and are not responsible for losses arising from interruptions or technical issues, except as expressly provided in Section 8.
14. Privacy Policy
Use of Rank Engine is subject to our Privacy Policy, available on our website.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of Malta. Disputes shall be brought exclusively in the courts of Malta.
16. Intellectual Property
All content on Rank Engine is owned by the Company or licensed third parties. Do not use without prior written consent. Contact us if you believe your intellectual property rights are infringed.
17. Severability
If any provision of these Terms is unenforceable, the remainder will still apply.
